INDIVIDUALS WHO DO NOT FOLLOW THESE CLUB RULES OR STATE LAW ARE SUBJECT TO REMOVAL FROM THE CLUB.

Mud Brothers of the North ATV Club

Bylaws

Article I: Name

Section 1. The name of the organization shall be the “Mud Brothers of the North ATV Club”.

Section 2. The Mud Brothers of the North ATV Club will hence forth be referred to as “Mud Brothers”.

Section 3. The official mailing address shall be P.O. Box 553, Indian River, MI 49749

Section 4. The official web address shall be www.mudbrothersatvclub.com.

 

Article II: Mission Statement

Section 1.  The purpose of the Mud Brothers of the North ATV Club is to advance the general welfare and safety of ATV/UTV recreation. To serve in the interest of ATV/UTV owners and other ATV/UTV enthusiasts and to perform all desirable and lawful functions for the successful operation of the club and in the general public interest. To take part in and host charity rides for local communities. Most importantly to promote community among the owners of all-terrain vehicles and gain access to trails for the enjoyment of ATV/UTV riding.

Article III: Purpose

Section 1. The purpose of the club is to:

 Stimulate and advance the general welfare and safety of ATV/UTV recreation.
 Educate and serve the interest of ATV/UTV enthusiast.
 Assist owners against discriminatory legislation, regulations and burdensome taxation.
 Promote enthusiasm among ATV/UTV users.
 To provide a medium for the exchange of ATV/UTV information.
 To perform all desirable and lawful functions.

Article IV: Membership

Section 1.  Three types, a board of directors which consist of eleven (11) members, regular members, and corporate sponsors.

Members of the board of directors have one equal vote per member.
Only board members can bring topics to the table and serve as a representative to other members.
Any form of membership must be nominated with a second and voted in by the board, with membership dues due at time of application.
Must be 18 to be a member.
A corporate sponsor, corporate members do not have to own an ATV/UTV. Businesses that wish to assist and promote safe ATV/UTV riding may become members upon payment of annual dues.
Any member can removed from the club, pending a vote of the board of directors.

Amendment May 2nd 2012 if an officer drops a position they may not run for another office position until the following election period.

Amendment May 16TH 2012 any corporate sponsor will include one (1) family membership

Or two (2) single memberships.

Amendment November 7TH 2018 Board will consist of no less than 7 and new board members can have a position with vote by board

Amendment June 1st 2020 members that are 16 with a valid ID can operate a OVR on club rides

Article V: Dues

Section 1. The amount of dues as well as the time for payment shall be determined from time to time by action of the board of directors.

Paid by all club members to the club Treasurer on an annual basis.
Annual dues due on Nov 1 and no later than Jan 1
Due amount shall be $20 for single member.
Due amount shall be $40.
Corporate sponsorship requires a minimum due of $50.

Amendment November 7TH 2018 membership will move to $40 and no single membership starting in 2019

Article VI:  Board of Directors

Section 1. The Board of Directors shall consist of no more than eleven (11) members with a President, Vice President, Treasurer, and a Secretary within the Board. With the officers having a term of one (1) year with the year beginning and ending on Nov 1.

Amendment May 1st 2013 board will consist of no less than 5 and no more than 11 members

Amendment Oct 7th 2014 board members must attend %80 of monthly board meetings, lack of attendance will result in possible deletion from the board per board vote, only board members that have served as an officer for one year are eligible for position of President.

Amendment Oct 11TH 2016 Voting will be done in October if no positions are contended.

Amendment Nov 8th 2018 Board can be over 11 members     

Section 2.

Any new proposed business needs a second to bring that business to a vote.
Any ties will be broken with a coin toss with the President calling the toss.
If any board members are absent from the meeting they can only vote on agenda items.
Vice President to fill in for any officer that is absent.
Any member of the board of directors can be removed from their position, with proper voting.

Article VII: Monthly Meetings

Section 1. Meetings shall consist of the following,

Call to order
Roll call
Report of treasurer
Report committees as needed
Welcome new members
Old business
New business
Schedule next meeting time and place
Adjournment

Section 2. Committee meetings may be scheduled at interval times to promote ongoing club projects.

Article VIII: Vacancies:

Section 1. A vacancy in any office because of death, resignation, removal or otherwise, may be filled by vote of the board for the remaining portion of the term at the meeting following the occurrence of the vacancy.

Article IX: Incidental Expenditures

Section 1. The club officers shall have the authority to expend no more than $50 for incidental and routine expenditures, i.e., stamps, office supplies, etc. without approval of the board of directors.

Article X: Amendments

Section 1. These by-laws may be amended at any annual or special meeting of the board of directors by a vote of a majority of the board of directors present, providing a quorum of club officers are present. All amendments shall be dated.

Article VII: Dissolution of Club Assets

Section 1: Dissolution of the Club

If, at any time, the Mud Brothers of the North ATV Club no longer exists for the purpose and objectives set forth its constitution, the Club will hereby be dissolved.

Section 2: Disposition of Club Assets

At the time of dissolution of the Club, any and all assets shall immediately revert to an entity named at the discretion of the Club at the last meeting.

                     Participation is the keystone to any organization!

New membership guidelines for 2024!

​Members must be capable of minimum in trail speeds of 35 or more and have a machine capable of faster speeds on open sections. Rides will be longer, harder and with challenging terrain for 2024, if you feel this might be to much for you sadly this club may not be for you. ​
